You can sue for damages beyond the deposit and you may win. Collecting is the problem. A tenant who trashed a house and left is frequently judgment proof, meaning there is nothing to collect against.

So you would be spending filing fees and attorney time for a piece of paper. Some landlords do it for the principle, which is their right. Very few come out ahead.

Insurance usually does not cover it

Landlord policies typically cover sudden and accidental damage, not gradual deterioration, neglect, or intentional damage by a tenant. Some policies offer vandalism coverage that may respond depending on the facts and the policy language.

Read the actual policy or ask your agent before assuming. A lot of landlords discover the exclusion at the worst possible moment.
