Someone dies without a will and no estate is opened. Their share passes to children, and when those children die it splits again. Two or three generations later there are half siblings from a first marriage, cousins who moved out of state, and people whose last known address is forty years old.
Each of them owns a fractional interest. A title company will find them in the chain, and every one has to be accounted for before the property can convey.
The warning order attorney
Kentucky civil procedure provides for serving defendants who cannot be found or whose whereabouts are unknown by appointing a warning order attorney. That attorney is charged with attempting to locate and notify the party, then reporting to the court.
It is how Kentucky courts handle absent parties in an action affecting real property. It adds time and cost, and it is a genuine path to a conveyable result rather than a dead end.
Search first, litigate second
Before anything goes to court, a real effort to locate people is worth making. Obituaries, probate records in other counties, property records, and genealogy databases turn up more heirs than families expect.
Often a supposedly missing heir is findable in an afternoon and happy to sign for a share of the proceeds. That is much cheaper than a court process, and it is where we would start.
