Separated is not divorced, and the house does not know the difference.
Two households on one income is the pressure most separations run into first. The mortgage does not adjust because somebody moved out.
Look at the numbers togetherThe financial squeeze comes fast
One household becomes two. Rent or a second mortgage appears while the original payment, taxes, insurance, and utilities all continue. Whichever spouse stayed in the house is often carrying a payment that was calculated on two incomes.
That is why a lot of separations reach a decision about the house long before they reach a decision about the marriage. It is not giving up, it is arithmetic.
Kentucky and legal separation
Kentucky provides for a decree of legal separation as an alternative to dissolution, and the property provisions work similarly in many respects. Some couples use it for religious, insurance, or benefit related reasons.
Either way, if both names are on the deed, both must sign to sell. Being separated changes nothing about that. Talk to your attorney about whether any court order limits what you can do with marital property while the case is pending.
Selling before the resentment compounds
The longer a jointly owned house sits through a separation, the more it collects. Who paid what. Who kept up the yard. Who was supposed to handle the roof. Every month adds a line to an argument you will eventually have to settle anyway.
A clean sale with a fixed date and a documented split removes an entire category of dispute. Both attorneys see the same offer, both parties see the same math.
Five questions. That is the whole thing.

Question 1 of 5
What people ask about this
Can I sell if my spouse moved out and stopped paying?
Not alone, if they are on the deed. Their non payment may matter in the eventual division, and it does not remove their signature requirement.
Do we need a court order to sell?
It depends on whether a case is pending and what orders are in place. Ask your attorney before signing anything.
What if my spouse will not cooperate at all?
That becomes a matter for the court, either in the dissolution case or through a partition action. Your attorney will know which path fits.
Often it is more than one thing at once
