How the deed was written decides most of what happens next.
Two houses that look identical can be entirely different situations depending on three words on a document filed years ago.
Understand your positionSurvivorship changes everything
If the deed conveyed the property to both spouses with right of survivorship, the surviving spouse generally takes full ownership at death without probate. If it did not, the deceased spouse's interest passes through their estate, which is a materially slower path.
Pull the deed from the county clerk and read the wording, or have an attorney read it. That one document determines whether this is simple or not, and most people have never looked at theirs.
Kentucky still has dower and curtesy
Kentucky retains dower and curtesy, the surviving spouse's statutory interest in the deceased spouse's real property. Very few states kept these, and they interact with wills, elective share rights, and prior conveyances in ways that surprise out of state attorneys.
If you were left out of a will, or if the property was conveyed at some point without your signature, this is worth asking a Kentucky attorney about specifically. There may be rights you do not know you have.
The mortgage and the practical side
Federal law generally protects a surviving spouse from due on sale enforcement when property transfers at death, and servicers have processes for a successor in interest to assume the loan. Contact the servicer in writing early, because they cannot help until they know.
Beyond that, take your time. A house that is too big, too much to maintain, or simply full of a life you are not ready to pack has no deadline attached. If and when you want a number, we will give you one without pressure.
Five questions. That is the whole thing.

Question 1 of 5
What people ask about this
Do I have to go through probate?
Not if the property was held with survivorship or in a trust. If it was in your spouse's name alone, generally yes.
Can I stay in the house?
In most cases yes, and there is no rush. Talk to your servicer about assuming the loan if there is a mortgage.
What if the will left the house to someone else?
Kentucky spousal rights, including dower and elective share, may still apply. This is a question for a Kentucky attorney and it is worth asking promptly.
