What a Master Commissioner actually is

Kentucky does not use trustee sales the way many states do. Foreclosure sales here are conducted by the Master Commissioner, an officer appointed by the circuit court in each county. They handle the advertising, run the sale, and report back to the court for confirmation.

Most people have never heard the term until it appears on their own paperwork, which is part of why this stage feels so disorienting. It is simply the court's mechanism for selling the property, and it runs on the court's schedule.

Beating the date means working backward from it

Title work, the payoff statement from the lender's attorney, and the actual funding all take time. Working backward, a realistic closing needs a couple of weeks, and more if there is a second lien or a title defect in the chain.

That is why the single most useful thing you can do right now is call rather than fill anything out. If your sale is three weeks away we can probably work with that. If it is Friday, we need to know that in the first sentence so we can tell you honestly whether it is possible.

The property is sold at the courthouse and the proceeds go to satisfy the judgment. Any surplus above what is owed belongs to you, but you have to claim it through the court, and a lot of people never do. Below the judgment amount, a deficiency may be pursued depending on the terms.

How late is too late?

There is no universal answer. What matters is whether a closing can fund and the judgment can be satisfied before the sale. Call and tell us the date first. We will tell you straight whether it is realistic.

Can the sale be postponed?

Sometimes, and that is a question for your attorney rather than for us. A pending contract on the property is occasionally a reason a court or a lender will agree to a continuance.

What if the house sells at auction for more than I owe?

The surplus belongs to you, but it is held by the court and has to be claimed. Ask the circuit court clerk about the process, because unclaimed surplus funds are common and avoidable.
